Workers' Compensation coverage is insurance benefits which pay for reasonable and necessary medical care if you get hurt or sick in the course of employment. The insurance will also pay part of your salary if it is medically necessary that you not work.

Neither lawsuits nor court proceedings are utilized for Workers' Compensation claims. No one has to prove that an employer was negligent or at fault, only that the injury occurred while the worker was on the job.

  • If you go one year without authorized medical treatment, the right to future medical treatment ends and your case closes.

  • If you have a Managed Care case you have a right to choose your own primary doctor, who can refer you to other specialists. You can have a change of physician and an IME (Independant Medical Examination).

  • The insurance company must pay your mileage for going to and from your doctors, and must reimburse you for prescriptions written by authorized doctors.

  • Workers' Compensation cases can settle for a lump sum of money. Generally speaking, the more an insurance company is paying on a case, the more the case will settle for.
